A ‘use it or lose it’ system means that employees must use their accrued holiday in that holiday year, e.g. Jan-Dec, or risk losing the unused number of days (and the pay). You should communicate clearly what your company’s annual leave policy is, and its stance towards holiday carry-over and whether holiday will be lost if not used. In the event you don’t let an employee take all of their holiday, you can open yourself up to legal claims. Staff can legally carry over holiday (up to 4 weeks) in the following circumstances: You don’t communicate that there is a ‘use it or lose it policy’. You do not let them take all their holiday or don’t encourage them to take it at all. Bear in mind that if an employee leaves their role, any unused holiday pay they have accrued will need to be paid.

During their notice period the worker may be able to take whatever is left of their statutory annual leave. Use the holiday entitlement calculator to work this out. How much they get depends on how much of the leave year has passed or how much leave they’ve accrued. Employers must pay for untaken statutory leave, even if the worker is dismissed for gross misconduct. The only time someone can get paid in place of taking statutory leave is when they leave their job.

The basic principle of annual leave is that if you don’t use it, you lose it. There are some exceptions to this rule but usually the annual leave accrued that year must be used in that year. Annual leave allows staff to have a sufficient break from work and permitting employees to carry leave over can sometimes create a practice of ‘saving up’ annual leave. However, there are some exceptions to watch out for, such as where an employee is unable to work due to long-term sickness, they are usually entitled to carry over 4 weeks of annual leave to the next year. Secondly, when an employee is on family-friendly leave the annual leave can be carried over to the following year when they return to work.
